DONATION RULES AND REGULATIONS FOR
THE MARIAN SCHMIDT FOUNDATION FOR THE VISUAL ARTS
I. GENERAL STATEMENTS
- The main purpose of the document is to describe the rules regarding making donations to support the statutory activities of the Marian Schmidt Foundation for the Visual Arts, hereinafter referred as The Foundation.
- Donations may be made on the website www.marianschmidt.org. The website is the property of The Marian Schmidt Foundation for the Visual Arts, domiciled in Warsaw 02-515, 1 Puławska street, apartment 48, registered in the National Court Register (KRS) with the number KRS 0000865932, REGON number 387377756.
- Donations are used only for statutory activities of the Foundation.
- Donors are obligated to understand the Donation rules and regulations prior to using payment service providers.
- Donations may be also made via traditional bank transfer on the bank account number 18 1870 1045 2078 1069 5802 0001 NestBank S.A. in Polish zloty, and for transfers from abroad: in Euro PL61 1870 1045 2078 1069 5802 0003, in USD PL34 1870 1045 2078 1069 5802 0004.

II. DONORS PERSONAL DETAILS
- Donors’ personal data is processed by The Marian Schmidt Foundation for the Visual Arts, 1 Puławska street, Warsaw, Poland for purposes as follows:
a) to make a donation – name and surname, i.e. essential personal data, that may be necessary to get a certificate/receipt for your donation for the Foundation. In case of making a donation via traditional bank transfer, the account number and address seen on the transfer will be also used. You must share your email address in order to make an online payment through payment in payment service providers.
b) to fulfill the Foundation statutory liability – we process the data associated with the payment, i.e. Donors name and surname, the amount of donation, bank account number, address (in case of bank transfer). This information is necessary to of fulfill the legal duty incumbent on the foundation’s data administrators. - Sharing personal data is voluntary, yet necessary to make a donation.
- All donors’ personal data is also shared with the following entities:
a) payment service providers, i.e. PayPal (Europe) S.à r.l. et Cie, S.C.A. domiciled in 22-24 Boulevard Royal, L-2449 Luxembourg and PayU S.A. domiciled in 60-166 Poznań, 186 Grunwaldzka street.
b) the bank holding the Foundation’s account – NestBank S.A. domiciled in 02-675 Warszawa, 24 Wołoska street. - All Donors’ personal data is stored until:
a) data has been processed in order to realize the agreement – until it is barred by limitation, i.e. 6 years since the moment of making a donation,
b) data has been processed in order to realize the legal duties – within a period stated in the accounting law, which is 7 years since the moment of making a donation. - Donors are permitted to have access to the content of the shared data and to demand changing it, deleting or limiting its processing, and transferring it. Donors are also permitted to make a complaint at the President of the Personal Data Protection Office.
III. SAFETY OF DONATIONS
Donations are protected by the SSL safety certificate, thanks to all transmitted information has been coded. In order to make a payment, the Foundation uses the services of two different payment service providers, i.e. PayU and PayPal.
IV. COMPLAINTS AND RESIGNATION FROM MAKING DONATIONS
- Donations cannot be returned, except due to issues stated in law.
- Each Donor is allowed to make a complaint about the issues related to their donation.
